How did RankBoards
get started?

I was doing some research on why we like certain people and products. We have things we really like – our favorites – and things that we don't think are all that great. We automatically rank things in our minds. It occurred to me that ranking is hardwired into our system.

Around this same time, my son Colin started firing off ranking questions to me. He started asking me:
“Dad, what is your favorite snake?”
“Dad, what is the best Japanese car?”
“Dad, I like the Siberian tiger, what is your favorite tiger?”

He continues to ask me these questions on a daily basis. Just this morning he asked me what my favorite wolf was; I never really thought about it, but just kind of assumed there was just one type of wolf. There are a bunch of different wolves! Well, now, my son has a place to list his favorite wolves, dinosaurs, and crustaceans! He can also ask other people to vote on them - a real win/win situation!

So, it was this research I was doing and the constant questions from my son that made me think that I should build something that allows people to vote, rank, and share things on the Web. I shared the idea with a bunch of people and they all said the same type of thing: “That's awesome! Wait, doesn't that exist?” Well, as far as I can tell, it doesn't exist. So we built it!

Beyond this basic foundation, our goal is to provide a way for you to vote, rank, and share the people and products that you are passionate about. If you are moving to a new area, then I want you to be able to quickly find the best dentists, day care providers, and cool spots to check out. If you are passionate about sports or celebrities, then I want you to be able to debate and vote up your team or actor. Additionally, I want you to be able to share more about who you are in a very easy way. I want your friends to be able to quickly learn about your favorite books and movies, but I also want them to know about who you are becoming. Life is a journey and it can be fun to let others know where we are going.

In short, I launched this site because I think we naturally rank and share things all of the time. I wanted there to be a place on the Web to do these things. And – I wanted my son to have a place to fire off questions to learn more about the world around him :)

RankBoards.com Terms of Service

Welcome to RankBoards! RankBoards is a service that allows you to vote on and create RankBoards for people, products, places, things, and experiences. RankBoards provides you with the ability to create your own visual lists or "RankBoards." You can also view, like, vote, follow, comment and repin images from other RankBoards on RankBoards.com and on mobile devices through our app. The services provided on RankBoards are referred to as the "service(s)."

Acceptance of Terms:

In order to be a member of RankBoards you must read and accept all of the terms of this agreement and the privacy policy. By using RankBoards you indicate that you understand that RankBoards can change the terms of service or the privacy policy by posting changes to this Website. Your ongoing use of RankBoards indicates that you accept any changes to the Terms of Service Agreement. We reserve the right to change or terminate RankBoards for any reason, and without notice, without liability to you, any other user, or any third party.

Registration

You understand and agree to the following:

1. You must use a valid e-mail address and create a username during the registration process.
2. You are responsible for all uses of your account. You must keep your password confidential. We may refuse, at our sole discretion, to allow you to register a username that is trademarked, inappropriate, or impersonates another individual.
3. You agree to let RankBoards immediately know of any unauthorized use of your account.
4. You must be 13 years old or older to use the service.
5. You understand and agree that RankBoards does not control, verify or endorse content or links provided by users. Any links that take users out of RankBoards are not under the control of RankBoards, so RankBoards is not responsible for any of the content, functions, services, or links of third party sites.
6. When registering with RankBoards, you must provide, and maintain, accurate, current, and complete information about yourself.
7. RankBoards reserves the right to refuse the Service to any user.

RankBoards Privacy Policy

Please review our privacy policy to better understand how we treat personal information, which is incorporated it its entirety into these Terms by this reference.

User Behavior

You are fully responsible for your behavior on RankBoards, which includes the way that you utilize any aspect of the RankBoards service.

1. You are completely and solely responsible for the content you post on RankBoards. Unauthorized or illegal content includes, but is not limited to:
   1. the display of sexually explicit material
   2. the display of abusive, bullying, harmful, racially or religiously offensive or bigoted, obscene, or libelous material.
   3. the use of flaming or trolling
   4. the display of material that encourages criminal behavior that violates any local, state, national, or international law or regulation.
   5. the use of the Service for unauthorized advertising, which includes MLM/pyramid schemes, spam, chain letters, sweepstakes or contests.
   6. the transmission of viruses, worms, or Trojan horses to destroy or limit any functionality of the software or hardware of RankBoards and its users.
   7. the display of information about another person without their express consent, or the posting of any copyrighted material that you do not have legal authorization to use.
2. You agree and understand that RankBoards can delete any content that is offensive, illegal, harmful, or in violation of the rights of other users and members.
3. Any member who demonstrably harasses or abuses another member will be removed from RankBoards.
4. Other unauthorized or illegal behaviors include, but are not limited to:
   1. the display of false information about yourself or anyone else
   2. changing, in any manner at all, or reverse engineering any aspect of RankBoards. You may not attempt to derive source code from the RankBoards service.
   3. the use of any search/retrieval application (e.g., robot, spider) to index any aspect of RankBoards
   4. the posting of information that implicitly or explicitly implies that it is endorsed by RankBoards
5. You agree to comply with all applicable laws with respect to
   1. Any gathering, disclosure, use, or collection of Personal Data (as that term is defined in the RankBoards Privacy Policy) and
   2. Email communications, including without limitation CAN-SPAM, applicable state laws, and applicable laws in non-U.S. jurisdictions.
6. You agree to comply with all aspects of the RankBoards Privacy Policy. You will not harvest emails from and you will only use email in accordance with these Terms of Service and Privacy Policy.

Content Submitted to RankBoards

RankBoards enables you to pin, upload, post content on the Service. This includes, but is not limited to images, photos, and comments. RankBoards does not own the Content you place on RankBoards. When you upload, submit, disclose, or distribute user content and/or Third Party Content through the RankBoards service, you automatically grant, and you represent and warrant that you have the right to grant, to RankBoards a perpetual, non-exclusive, transferable, fully paid, worldwide license to use, copy, publicly perform, publicly display and distribute such Third Party Content on the Site to the extent necessary to promote such Third Party Content. You can remove content that you upload to RankBoards.

RankBoards does not pre-screen content; however, RankBoards does have the right to remove Content that it deems objectionable or violates the Terms. You also recognize that you bear all risks associated with the use of any Content.

RankBoards is a public site, so the content you submit will be viewed by others. Other people can see, repin, use, reorganize, like, and comment on your content. RankBoards may retain your content upon termination of your account for backup, archival, or audit reasons. Moreover, RankBoards and other Users can continue to reuse your content if they have re-pinned to their own boards or is public in other areas of the Service.

Copyright Infringement

RankBoards respects copyright and other laws. Rankboards is in accordance with the Digital Millennium Copyright Act of 1998. RankBoards requires all users to comply with copyright and other laws. As a member of RankBoards, you agree that you must not use RankBoards to infringe the intellectual property of others in any way. The unauthorized reproduction, distribution, modification, or posting of copyrighted work is a violation of copyright law. You are responsible for your behavior on RankBoards and for making sure that it does not violate any copyright laws. If you violate copyright laws, then you may be exposed to civil and criminal liability.

RankBoards will quickly respond to claims of copyright infringement on the RankBoards site that are reported to our copyright agent (see below). If you are a copyright owner and believe that a user has infringed on your copyright, then please complete the process outlined immediately below. Once we receive the notice, we will take whatever action that we deem appropriate, including the removal of the infringing material.

1. Document the item(s) you claim are being infringed upon. Provide a URL to the items on RankBoards and also a link to the reference site.
2. In the body of the letter, state that you believe that the disputed use of the material is not authorized by the copyright owner. Include that you are being an accurate reporter and, under penalty of perjury, that you are the owner, or an authorized agent acting on behalf of the copyright owner.
3. Include your email, phone number, address, full legal name and your physical signature on the letter.

Trademarks and Proprietary Rights

RankBoards graphics, logos, designs, page headers, scripts and service names are registered trademarks. You agree to protect company proprietary information. You recognize that the Service and software used in connection with the Service is protected by intellectual property and other laws. You acknowledge that disclosing or utilizing Rankboards' proprietary information in any way inconsistent with these Terms of Service will cause damage and we will have the right to:

1. equitable and injunctive relief to prevent such prohibited use or disclosure, and
2. recover the amount of all damages (including attorneys fees and expenses) in connection with such prohibited use or disclosure.

Deactivation/Termination of Your Account

You can deactivate, or terminate, your account at any time and for any reason. RankBoards can also deactivate, or terminate, your account at any time and for any reason. We also reserve the right to use any means (legal, operational, or technological) available to enforce these Terms of Service. Once deactivation occurs, your rights to the RankBoards platform and Service will cease to exist. The following provisions and licenses will survive termination of these Terms of Service: Licenses from You, Licenses to Content, Content and Interaction, User Behavior, Your Warranties, Limitations of Liability, and Indemnity.

Advertiser Links and Hyperlinks to Third Party Sites

RankBoards is not responsible for and does not control any information, products, or services found via links on third party websites. You agree to assume sole responsibility for your use of third party sites. You may communicate with, be directed to, and/or obtain services/goods from third parties (known as "Advertisers") such as advertisers, promotional partners, or sponsoring organizations. All interaction is solely between you and the third party. RankBoards will not be responsible or liable in any way in connection with these activities or transactions.

Users regularly post third party links and hyperlinks. RankBoards does not endorse nor does it incur any obligation, responsibility, or liability on the part of RankBoards, its successors and assigns, or any of their respective officers, directors, employees, agents, representatives, licensors, licensees, Advertisers, suppliers, and operational service providers.

Limitations of Liability

RankBoards and its affiliates, partners, and consultants disclaim any and all responsibility or liability for the content, completeness, accuracy, legality, reliability, or availability of information displayed on RankBoards. You agree that the use of the Service and anything thing that you read on RankBoards is at your sole risk, discretion, and responsibility. RankBoards disclaims any and all responsibility and liability for the conduct of any member. RankBoards will not be held liable for any interactions you have with other individuals or organizations through the Service. You agree that RankBoards is not responsible for any damage or loss that occurs as a result of such interactions and that RankBoards has no obligation to become involved in any such disputes; further, you release RankBoards from damages of any kind that arise from such disputes. RankBoards offers all of its service on an "as is" basis, with no warranties whatsoever. RankBoards expressly disclaims to the fullest extent permitted by law all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."

Indemnity

You agree, at your expense, to indemnify, defend and hold RankBoards harmless from and against any loss, cost, damages, liability and/or expense arising out of or relating to (a) third party claims, actions or allegations of infringement based on information, data or content you submitted in connection with the service, (b) any fraud or manipulation, or other breach of this agreement by you, or (c) third party claims, actions or allegations brought against RankBoards arising out of your use of the service or software, (d) any breach/violation of these Terms of Service, (e) the misuse or criminal, or theft of, your email or password, (f) the disclosure of your password or email address, (f) your consent to let someone else use your email address or password.

Termination

RankBoards can refuse signing up, registration, or membership to any User at its sole discretion. In addition, RankBoards can terminate the account and delete any related information of any member at any time for any reason. You agree and understand that you can terminate your membership at any time for any reason. If RankBoards terminates your membership, then you can no longer use the RankBoards service or the services of any of its affiliates.

Other Terms

This Terms of Service Agreement is governed in all respects by the laws of the State of Virginia, USA, and any disputes arising hereunder shall be submitted to state and federal courts in Norfolk, VA and you agree to and consent to the exclusive jurisdiction of such courts. If any aspect of this agreement is deemed invalid, then the remaining provisions shall still be enforced. You may not transfer this Agreement and any attempt to the contrary is void. RankBoards is not responsible for any delay or failure in performance resulting directly or indirectly from causes beyond RankBoards' reasonable control. Any correspondence about this Agreement will be sent to you via the email that you provided during registration.

International Use

If you are not a resident of the United States of America, then you agree to follow all applicable laws and local rules regarding the transmission of data from the United States and the country in which you live.

This Terms of Service represents the complete, entire, and exclusive understanding and agreement between you and RankBoards. It supersedes all prior, written or oral, understandings or agreements. You understand and agree that you have read these Terms of Service and amendments can be posted to this Terms of Service. You agree and understand that your continued use of the Service represents your consent to such amended terms.
